TNT AUCTIONS TERMS AND CONDITIONS OF SALE & CONSIGNMENT AGREEMENT 1. AS-IS / WHERE-IS CONDITION All items offered for sale by TNT Auctions are sold AS IS, WHERE IS, WITH ALL FAULTS, and without warranties or guarantees of any kind, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose. TNT Auctions makes no representations or warranties as to condition, description, authenticity, age, mileage, hours, operability, completeness, or title status of any item. Errors, omissions, discrepancies, photographs, verbal statements, or advertisements shall not constitute grounds for cancellation, refund, return, or price adjustment. All items are sold in the exact condition and configuration as they exist on the auction lot on the day of sale. Buyers are encouraged to inspect items prior to bidding. Failure to inspect does not relieve buyer responsibility. 2. TITLE & REGISTRATION DISCLAIMER All vehicles, trailers, trucks, equipment, or other items requiring title or registration are sold with a Bill of Sale only, unless explicitly stated in writing that the item is sold with a valid title. No titles are implied or guaranteed. Buyers are solely responsible for determining title transfer requirements and legal compliance. 3. BILL OF SALE A Bill of Sale will be provided when applicable and constitutes the entire transfer document unless otherwise stated in writing. 4. RISK OF LOSS Risk of loss transfers immediately to buyer upon being declared the successful bidder. TNT Auctions is not responsible for theft, fire, vandalism, or damage after sale. 5. BUYER’S PREMIUM In-Person Bidders: 6% Online Bidders: 12% Online bidding conducted through HiBid.com. 6. PAYMENT TERMS Payment is due in full on day of sale. Accepted forms: Cash Approved Check with valid ID Debit Card Credit Card (4% processing fee applies) Online bidder cards on file will be automatically processed unless prior arrangements are made immediately after auction. Failure to pay constitutes default. 7. ITEM REMOVAL & STORAGE Items must be removed by 5:00 PM Friday following the auction. Storage Fee: $10.00 per item, per day beginning the next calendar day. Items not removed may be resold, relocated, or disposed of without refund. 8. DEFAULT Failure to comply with payment or removal terms may result in: Sales Cancellation Forfeiture of items Suspension of bidding privileges Legal action CONSIGNMENT TERMS 9. COMMISSION 15% commission on final hammer price. Deducted from proceeds before consignor payment. 10. NO SALE (PO) ITEMS $25.00 PO Fee per item due at pickup. No item will be released until PO fee paid. All no-sale items must be removed by 5:00 PM Friday following sale. 11. CONSIGNOR REQUIREMENTS Consignor must: Complete Consignor Form Sign Consignment Contract 12. RESERVE PRICES Reserve prices permitted. If reserve is met, 15% commission applies. TNT Auctions may refuse unreasonable reserves. 13. CONDITION DISCLOSURE All item details must be provided in writing. Consignors must disclose all known defects, damage, or title issues in writing. Failure to disclose may result in liability to consigner. 14. TITLE REQUIREMENTS FOR CONSIGNORS Titles must be delivered to TNT Auctions by Friday prior to sale. 15. RIGHT TO REFUSE TNT Auctions reserves the right to refuse any item for any reason. LEGAL PROTECTIONS 16.
